TERMS OF SALE
The terms and conditions of sale that apply to your purchase of products via this website are set out below. Placement of an order with us is confirmation that you accept these terms and conditions.
We may amend these terms of sale from time to time. By continuing to use this site after any amendment you are deemed to have agreed to the amended terms of sale.
We will not be responsible for any delay or failure to comply with our obligations under these terms of sale, if the delay or failure results from any cause which is beyond our reasonable control.
We endeavour to ensure that the content of this website is current and accurate. If any inaccurate content is brought to our attention we will correct it within a reasonable time.
All intellectual property on this website is owned by us, Barfoot and Thompson, or our content suppliers. We are the exclusive owner of all rights in the compilation, design and layout of this site.
The products will comply in all material respects with the photographs and product descriptions appearing on this site at the time you place your order.
We do not warrant that any of our products are fit for any specific purpose, as we do not manufacture the products we sell.
All pricing on the site is in New Zealand Dollars, excluding GST at 15%. Handling and delivery charges are additional.
We reserve the right to amend or rectify any errors in pricing or product specifications once we become aware of the errors.
Two different payment methods apply on this site.
Sales on credit as per our standard Terms and Conditions of Sale. These apply to authorised Head Office personnel (authorised by Marketing Manager), Branch Managers, and their authorised branch staff
Credit Card Payments, which apply to all other Barfoots staff other than those able to purchase on credit.
Sales on credit are invoiced to Head Office or the appropriate branch, and paid by Barfoots accounts department.
All credit card payments are processed securely by DPS (Direct Payment Services). AMPM does not collect or store any credit card information. This information is all processed by DPS. When purchasing products with payment by credit card you will be directed to a secure webpage hosted by DPS to enter your payment details.
We endeavour to deliver all products within New Zealand within 3-5 days of receiving your order. All packages require a signature upon delivery. You agree that proof of delivery supplied by our courier company is sufficient evidence to establish that the goods have been received.
If we are unable to supply or expect a significant delay (e.g. if the product is out of stock) we will notify you as soon as reasonably possible after we become aware of the problem. Items which are not in stock will be back ordered for you, unless you notify us to the contrary.
We will not be liable to you for any damages, costs or expenses incurred as a result of the order not being filled or items not being delivered within the expected delivery time.
We may collect personal information about you through your use of this site and the services offered through it.
We will only use your personal information in connection with processing your orders, responding to your queries or informing you of special offers.
We may share your personal information with Barfoots Head Office, or with third parties as necessary in connection with processing your order (e.g. to courier company to enable delivery), or as required by law.
Except as provided, we will not share your personal information with any other third parties.
You are entitled to obtain confirmation from us about whether we hold personal information about you, and you may request that we change this information if it is inaccurate.
You are responsible for maintaining the confidentiality of your account and password, and for preventing unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. If you suspect that your password is no longer secure or may be used by unauthorised persons you should inform us immediately.
If you receive faulty or damaged goods please contact us within 3 days of receiving the goods.
You must inform us within 5 working days if any goods are lost or damaged in transit, so we can initiate an investigation at the delivery company and rectify the problem.
If you return the goods, please note that they are at your own risk until we receive them. Please send returns well packaged, via a reputable courier that provides a track and trace facility. The returned items must be in their original packaging, and have not been worn, used, or had their labels removed.
We do not accept returns of sale items (e.g. ends of lines).
